Responding to volatile criticisms frequently leveled at Leo Strauss and those he influenced, the prominent contributors to this volume demonstrate the profound influence that Strauss and his students have exerted on American liberal democracy and contemporary political thought. By stressing the enduring vitality of classic books and by articulating the theoretical and practical flaws of relativism and historicism, the contributors argue that Strauss and the Straussians have identified fundamental crises of modernity and liberal democracy.

DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. John McMillan's article raises numerous important points about the ethics of surgical castration of sex offenders.1 In this commentary, we focus solely on and argue against the claim that the offer of release from detention conditional upon surgical castration is a coercive offer that compromises the validity of the offender's consent. We take no view on the question as to whether castration for sex offenders is ethically permissible. But, we reject the claim that it is ethically permissible only if (...) competing ethical considerations outweigh worries about coercion. For in the situation described, the proposal is not coercive at all.McMillan states that if offenders agree to castration because they fear long-term detention, then ‘it seems, intuitively, as if agreeing to be castrated under these conditions makes the decision coerced in some way.’1 He adds that if castration is ‘the only way that they will be released back into the community, the status of this decision as a genuine expression of their autonomy is questionable.’1 In defence of his claim, he uses two analogies that he borrows from Joel Feinberg. First, if a governor offers to commute a death sentence if the prisoner agrees to participate in a medical experiment, then ‘it's clear that the governor is coercing the prisoner.’1 Second, if a millionaire offers to give a woman $1 000 000 …. Cooperation can evolve in the context of cognitive activities such as perception, attention, memory, and decision making, in addition to physical activities such as hunting, gathering, warfare, and childcare. The social insects are well known to cooperate on both physical and cognitive tasks, but the idea of cognitive cooperation in humans has not received widespread attention or systematic study. The traditional psychological literature often gives the impression that groups are dysfunctional cognitive units, while evolutionary psychologists have so far studied cognition (...) primarily at the individual level. We present two experiments that demonstrate the superiority of thinking in groups, but only for tasks that are sufficiently challenging to exceed the capacity of individuals. One of the experiments is in a brain-storming format, where advantages of real groups over nominal groups have been notoriously difficult to demonstrate. Cognitive cooperation might often operate beneath conscious awareness and take place without the need for overt training, as evolutionary psychologists have stressed for individual-level cognitive adaptations. In general, cognitive cooperation should be a central subject in human evolutionary psychology, as it already is in the study of the social insects. (shrink)

Civil wrongs occupy a significant place in private law. They are particularly prominent in tort law, but equally have a place in contract law, property and intellectual property law, unjust enrichment, fiduciary law, and in equity more broadly. Civil wrongs are also a preoccupation of leading general theories of private law, including corrective justice and civil recourse theories. According to these and other theories, the centrality of civil wrongs to civil liability shows that private law is fundamentally concerned with the (...) expression and enforcement of norms of justice appropriate to interpersonal interaction and association. Others, sounding notes of caution or criticism, argue that a preoccupation with wrongs and remedies has meant neglect of other ways in which private law serves justice, and ways in which private law serves values other than justice. This volume comprises original papers written by a wide variety of legal theorists and philosophers exploring the nature of civil wrongs, their place in private law, and their relationship to other forms of wrongdoing. The A-theory and the B-theory advance competing claims about how time is grounded. The A-theory says that A-facts are more fundamental in grounding time than are B-facts, and the B-theory says the reverse. We argue that whichever theory is true of the actual world is also true of all possible worlds containing time. We do this by arguing that time is uniquely groundable: however time is actually grounded, it is necessarily grounded in that way. It follows that if either the (...) The constructs of behavioral mass in research on the momentum of operant behavior and associative strength in Pavlovian conditioning have some interesting parallels, as suggested by Savastano & Miller. Some recent findings challenge the strict separation of operant and Pavlovian determiners of response rate and resistance to change in behavioral momentum, renewing the need for research on the interaction of processes that have traditionally been studied separately. Relatedly, Furedy notes that some autonomic responses may be refractory to conditioning, but (...) a combination of operant contingencies and enriched Pavlovian stimulus-reinforcer relations may prove effective. The frame problem refers to the fact that organisms must be able to zero in on relevant aspects of the world and intelligently ignore the vast majority of the world that is irrelevant to their goals. In this paper we aim to point out the connection between two leading frameworks for thinking about how organisms achieve this. Predictive processing is a rapidly growing framework within cognitive science which suggests that organisms assign a high ‘weight’ to relevant aspects of the world, (...) effectively treating relevant aspects of the world as if they are more precise. This assignment of weight is called precision-weighting and is the predictive processing account of how organisms allocate their attention. Relevance Realization is a framework that conceptualizes an organism’s ability to realize relevance as resulting from a dynamical system in which a cognitive agent makes use of opponent processing relationships to zero in on relevant aspects of the world. In this paper we use recent work on the diametric model of autism and psychosis to demonstrate that the tradeoffs inherent to precision-weighting are also inherent to relevance realization. This connection will demonstrate that although these frameworks have a different intellectual background and use a different set of concepts and vocabulary, they are both pointing to the same underlying process. The fact that these different frameworks have converged on such a similar solution to the problem of how organisms realize relevance serves to demonstrate the plausibility of that solution. (shrink)

While it is still some way from commercial production, in vitro meat is drawing significant media coverage. IVM’s promise is meat without suffering, with a diminished ecological footprint and potential for addressing global food shortages. For all its novelty, IVM has been present in creative literature since at least 1881, with a particular concentration of references appearing in Cold War science fiction. After an initial survey of the literary pre-history of in vitro meat, this chapter focuses on Frederik Pohl and (...) Cyril Kornbluth’s 1952 novel The Space Merchants, a stinging critique of post-war programmes of agricultural intensification that revolves around Chicken Little, a decades-old “hundred-ton lump of grey-brown rubbery flesh”. Although the novel nostalgically valorises a lost pastoral world of purportedly authentic human–animal relations, The Space Merchants is not a straightforwardly conservative text, however, but one which raises crucial questions about the cultural meaning and ideological function of IVM. Richard Rorty’s writings have long frustrated scholars of classical American philosophy. Robert Brandom’s recent engagements with the history of pragmatism have been met with similar disdain. This essay draws on Larry A. Hickman’s theory of technology and tool-use to find a productive framework for thinking through these interpretations. Foregrounding the purposes that guide their readings, we may find value where many readers have seen only ignorance. This strategy does not embrace interpretive relativism, nor does it preclude all scholarly criticism, but (...) it instead promises a living and engaged approach to working with the history of philosophy. On June 16, 1966, the New England Journal of Medicine published “Ethics and Clinical Research” by Henry K. Beecher. Beecher’s account of 22 examples of unethical contemporary clinical research shook up the medical profession and helped pave the way for U.S. federal regulation of research involving human subjects. Five decades later, in this issue of Perspectives in Biology and Medicine, we pay tribute to the lasting significance of this whistle-blowing article and to the remarkable contributions of Henry Beecher. Debriefing is a standard ethical requirement for human research involving the use of deception. Little systematic attention, however, has been devoted to explaining the ethical significance of debriefing and the specific ethical functions that it serves. In this article, we develop an account of debriefing as a tool of moral accountability for the prima facie wrong of deception. Specifically, we contend that debriefing should include a responsibility to promote transparency by explaining the deception and its rationale, to provide an apology (...) to subjects for infringing the principle of respect for persons, and to offer subjects an opportunity to withdraw their data. We also present recommendations concerning the discussion of deception in scientific articles reporting the results of research using deception. (shrink)

The dominant unspoken philosophical basis of medical care in the United States is a form of Cartesian reductionism that views the body as a machine and medical professionals as technicians whose job is to repair that machine. The purpose of this paper is to advocate for an alternative philosophy of medicine based on the concept of healing relationships between clinicians and patients. This is accomplished first by exploring the ethical and philosophical work of Pellegrino and Thomasma and then by connecting (...) Martin Buber's philosophical work on the nature of relationships to an empirically derived model of the medical healing relationship. The Healing Relationship Model was developed by the authors through qualitative analysis of interviews of physicians and patients. Clinician-patient healing relationships are a special form of what Buber calls I-Thou relationships, characterized by dialog and mutuality, but a mutuality limited by the inherent asymmetry of the clinician-patient relationship. The Healing Relationship Model identifies three processes necessary for such relationships to develop and be sustained: Valuing, Appreciating Power and Abiding. We explore in detail how these processes, as well as other components of the model resonate with Buber's concepts of I-Thou and I-It relationships. The resulting combined conceptual model illuminates the wholeness underlying the dual roles of clinicians as healers and providers of technical biomedicine. On the basis of our analysis, we argue that health care should be focused on healing, with I-Thou relationships at its core. (shrink)

The rise of the phenomenon of virtue ethics in recent years has increased at a rapid pace. Such an explosion carries with it a number of great possibilities, as well as risks. This book examines the many ethical issues that are encountered in the Pediatric Intensive Care Unit. It supports pediatricians, nurses, residents, and other providers in their daily management of critically ill children with the dilemmas that arise. It begins by examining the evolution of pediatric critical care, and who is now impacted by this advancing medical technology. Subsequent chapters explore specific ethical concerns and controversies that are commonly encountered. These topics include how to conduct end-of-life discussions with families facing a (...) myriad of challenging choices. It goes on to explore the concept of futility, and what that does and does not mean in the pediatric ICU setting. Controversial subjects such as children as organ donors, particularly using donation after cardiac death, in addition to issues surrounding the declaration of brain death are covered. Additional chapters address resource allocation, and also analyze the use of long-term technology in chronically critically ill children. Chapters include case examples with guidance on how to work through similar difficulties and decision-making. While this book is specifically targeted for care providers at the ICU bedside, it is also of benefit to medical students, students in bioethics, practicing ethical consultants and families who are dealing with critically ill children. This chapter presents some rather different ideas about the organization of the prefrontal cortex. Rather than fixed functional specialization, it emphasizes adaptability of neural coding to fit a behavioral context. In particular, it presents both neuroimaging and single-unit electrophysiological evidence to suggest that, in selected regions of the prefrontal cortex, neurons adapt their properties to code just that information of relevance to current behavior. This adaptation is a major contributor to the achievement of cognitive focus and control. Although this adaptive (...) coding model recognizes important regional specializations within the prefrontal cortex, it suggests a perspective on these that is rather different from that presumed in the traditional divide-and-conquer approach. We discuss misinformation about “the liar antinomy” with special reference to Tarski’s 1933 truth-definition paper [1]. Lies are speech-acts, not merely sentences or propositions. Roughly, lies are statements of propositions not believed by their speakers. Speakers who state their false beliefs are often not lying. And speakers who state true propositions that they don’t believe are often lying—regardless of whether the non-belief is disbelief. Persons who state propositions on which they have no opinion are lying as much as those who (...) state propositions they believe to be false. Not all lies are statements of false propositions—some lies are true; some have no truth-value. People who only occasionally lie are not liars: roughly, liars repeatedly and habitually lie. Some half-truths are statements intended to mislead even though the speakers “interpret” the sentences used as expressing true propositions. Others are statements of propositions believed by the speakers to be questionable but without revealing their supposed problematic nature. The two “formulations” of “the antinomy of the liar” in [1], pp.157–8 and 161–2, have nothing to do with lying or liars. In this project I claim that Dewey's version of pragmatism leads to an approach to identifying and addressing conflicts between human and nonhuman interests which help bridge the gap between practice and theory in environmental ethics. I claim that traditional arguments in environmental ethics often give little or no guidance to resolving conflicts faced by those involved with environmental practice. After describing traditional arguments in environmental ethics, I argue that Dewey's philosophy offers an alternative to those arguments which gives direction (...) to practitioners for resolving conflicts so that all parties to a conflict "grow" as a result of the conflict. ;In my examination of Dewey's philosophy I focus on the notions of inquiry, experience, growth, the idea of character in moral judgment, and Dewey's concept of the "good". I show how the focus which comes from an examination of those concepts directs us to focus on particular difficulties faced by particular people as they move around in their lives and come in conflict with different views, their own and others, about what is the "right" course of action. I also show how a Deweyan approach to environmental ethics lends support to major claims of the ecofeminists. (shrink)

If the block universe view is correct, the future and the past have similar status and one would expect physical theories to involve final as well as initial boundary conditions. A plausible consistency condition between the initial and final boundary conditions in non-relativistic quantum mechanics leads to the idea that the properties of macroscopic quantum systems, relevantly measuring instruments, are uniquely determined by the boundary conditions. An important element in reaching that conclusion is that preparations and measurements belong in a (...) special class because they involve many subsystems, at least some of which do not form superpositions of their physical properties before the boundary conditions are imposed. It is suggested that the primary role of the formalism of standard quantum mechanics is to provide the consistency condition on the boundary conditions rather than the properties of quantum systems. Expressions are proposed for assigning a set of (unmeasured) physical properties to a quantum system at all times. The physical properties avoid the logical inconsistencies implied by the no-go theorems because they are assigned differently from standard quantum mechanics. Since measurement outcomes are determined by the boundary conditions, they help determine, rather than are determined by, the physical properties of quantum systems. (shrink)

This paper examines workplace surveillance and monitoring. It is argued that privacy is a moral right, and while such surveillance and monitoring can be justified in some circumstances, there is a presumption against the infringement of privacy. An account of privacy precedes consideration of various arguments frequently given for the surveillance and monitoring of employees, arguments which look at the benefits, or supposed benefits, to employees as well as to employers. The paper examines the general monitoring of work, and the (...) monitoring of email, listservers and the World Wide Web. It is argued that many of the common justifications given for this surveillance and monitoring do not stand up to close scrutiny. (shrink)

Descende caelo, Horace's ode 3.4, challenges the reader with an elaborate Pindaric architecture embracing seemingly disparate elements. After an opening invocation, the poet discourses at length on how the Muses protect him, then abruptly notes that those goddesses also nourished Octavian after his recent military campaign. This breaks off into a composite Titanomachy/Gigantomachy, followed by a set of maxims which the poet further illustrates with other mythical exempla. This paper contends that the relationship among these various parts comes into clearest (...) focus in the five-line description of the god Apollo that closes the Gigantomachy. This passage lies at the heart of the entire poem's major interpretive issuespoetics, panegyric, allusion, and structure but its pivotal role in the ode deserves fuller acknowledgement. (shrink)
